On August 17, 2011, the Union Ministry of Commerce has given Export Inspection Council of India (EIC) the mandate to check the clauses of technical barriers to trade (TBT) that apply to Indian exports. This has been instructed by World Trade Organization (WTO) as placed by different countries to India for information and the EIC in turn have demanded the industry bodies to file their responses immediately for further follow-up.
One notification from Environment Protection Agency (EPA) of USA proposes significant new use rule (SNUR) under Section 5(a) (2) of the Toxic Substances Control Act for fourteen glymes falling under this rule. According to this rule, any person who manufactures, imports, or processes the glymes for a new use has to inform EPA at least 90 days before starting that activity. The much needed notification is likely to provide EPA with the scope to determine the purpose of use and, if required, to cancel or control and minimize that activity before that happens.
Thailand harbors a notification on hazardous substances. The Thai Ministry of Industry has scrapped large number of hazardous items that are used for preventing or controlling insects, weeds, plant disease, namely, neem, citronella, curcuma, ginger, galangal, marigold, bitter bush, tea seed cake, chili celery, ringworm bush, climbing lily and Stemona tuberose Lour. However, the usage of these items is still under the authority of the Department of Agriculture, and is used for Ayurvedic formulations as well.
The EIC has asked the associations in India to harp on whether the notifications are in tandem with international standards or they are stricter to meet protection of human health, animal or plant life, environment and to prevent deceptive practices.
